We use the acronym SCUM to discuss broker mismanagement issues:

  • Suitability = A broker recommends a purchase, sale, or exchange of security without thorough understanding of the investor's financial status, investment objectives, risk tolerance, and level of sophistication. Brokers must know their customer and make suitable recommendations.
  • Churning = A broker excessively trades within an investor's account, at a level not justified by the investor's objectives and financial situation.
  • Unauthorized trading = Investor approval is needed before a trade, unless an investor has given written approval
  • Misrepresentations = A broker must give an investor all relevant facts about a security before the investor buys, sells, or exchanges that security at the broker's recommendation. It is malpractice to conceal relevant facts or fail to disclose potential risks.
